Terms of Service

By accessing or using Custom Commands (the "Service"), including our website at makeown.cc and our Discord bot, you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Custom Commands ("we", "us", or "our").

If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. In that case, "you" refers to both you and the organisation.

If you do not agree to these Terms, you must immediately discontinue use of the Service. Your continued use after any modification to these Terms constitutes acceptance of the updated Terms.

Custom Commands provides a Discord bot and web-based dashboard that enables Discord server administrators to create and manage custom commands, rich embed responses, automated role assignments, and server automation workflows (collectively the "Service").

The Service consists of three primary components:

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

To use Custom Commands you must:

• Be at least 13 years of age, in accordance with Discord's minimum age requirement.
• Hold a valid Discord account in good standing.
• Have the legal authority to agree to these Terms on behalf of yourself or your organisation.
• Not be located in a country subject to a U.S. Government embargo or designated as a 'terrorist supporting' country.
• Not be listed on any U.S. Government prohibited or restricted parties list.

By using the Service, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet these requirements, you must not access or use the Service.

Access to the dashboard requires authentication via Discord OAuth2. You are responsible for maintaining the security of your Discord account and for all activities that occur under it.

You must notify us immediately if you become aware of any unauthorised use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this obligation.

We reserve the right to terminate or suspend access to your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the Service.

Custom Commands is designed to help Discord server operators build better communities. You agree to use the Service only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations.

Permitted uses include:

• Creating text, embed, and role-based commands for your own Discord servers.
• Automating welcome messages, information responses, and community workflows.
• Managing role assignments based on member interactions.
• Using the dashboard to configure and maintain the above features.

The following activities are strictly prohibited and may result in immediate termination of your access:

We reserve the right — but not the obligation — to monitor use of the Service and to investigate and take appropriate action against anyone who, in our sole discretion, violates these provisions.

The Service and its original content — including but not limited to software code, design systems, logos, graphics, and documentation — are and remain the exclusive property of Custom Commands and its licensors, protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for its intended purpose in accordance with these Terms. This licence does not include:

• Copying, modifying, or distributing the source code of the Service.
• Creating derivative works based on the Service or its design.
• Using Custom Commands's name, logo, or branding in any manner that implies endorsement without written consent.
• Removing or altering any copyright, trademark, or other proprietary notices.

Your command configurations, embed designs, and other content you create through the dashboard remain your property. By creating this content you grant us a limited licence to store and execute it for the purpose of providing the Service to you.

Custom Commands offers optional paid premium tiers that unlock additional features. All payments are processed securely through Stripe. By purchasing a premium plan you additionally agree to Stripe's Terms of Service.

Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time through the dashboard; cancellation takes effect at the end of the current paid period. We do not provide pro-rata refunds for mid-period cancellations.

We reserve the right to change pricing at any time. Price changes for active subscriptions will be communicated at least 14 days in advance via email or Discord announcement. Continued use after the effective date constitutes acceptance.

In the event that premium features are removed from the Service during an active subscription period, we will provide a proportional credit or alternative remedy at our discretion.

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

• Scheduled or emergency maintenance windows.
• Discord API outages or rate limit changes beyond our control.
• Infrastructure failures, DDoS attacks, or other external events.
• Force majeure events including natural disasters, pandemics, or governmental actions.

We will make reasonable efforts to notify users of planned downtime in advance via our Discord support server. We are not liable for any losses arising from service interruptions.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CUSTOM COMMANDS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose.
• Warranties that the Service will meet your requirements or expectations.
• Warranties that the Service will be uninterrupted, timely, secure, or error-free.
• Warranties regarding the accuracy or reliability of any results obtained through the Service.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you in their entirety.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CUSTOM COMMANDS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or other intangible losses.
• Damages resulting from your access to or use of (or inability to access or use) the Service.
• Damages resulting from unauthorised access to or alteration of your transmissions or data.
• Damages resulting from conduct of any third party on the Service.

In all cases, Custom Commands's total cumulative liability to you for any claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) USD $10.

You agree to defend, indemnify, and hold harmless Custom Commands and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

• Your violation of these Terms.
• Your use of the Service in a manner not authorised by these Terms.
• Any content you create, configure, or distribute through the Service.
• Your violation of any third-party rights, including intellectual property or privacy rights.
• Any claim that your use of the Service caused damage to a third party.

Either party may terminate the agreement created by these Terms at any time.

You may terminate by removing the bot from all your Discord servers and ceasing use of the dashboard. Removing the bot triggers deletion of your command configurations within 7 days.

We may terminate or suspend your access immediately, without prior notice or liability, for any reason including — but not limited to — a breach of these Terms. Grounds for immediate termination include:

• Violation of the Prohibited Activities section.
• Chargebacks or payment disputes raised in bad faith.
• Use of the Service in a manner that could expose us to legal liability.
• A request by law enforcement or other governmental authority.

Upon termination, all licences granted to you cease immediately. Provisions of these Terms that by their nature should survive termination shall do so, including but not limited to the Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Indemnification sections.

We reserve the right to modify these Terms at any time at our sole discretion. When changes are made, we will update the "Last updated" date at the top of this page.

For material changes — such as those affecting payment terms, data handling, or user rights — we will provide at least 14 days notice via an announcement in our Discord support server before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your binding acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service.

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the appropriate courts of competent jurisdiction, and you hereby consent to personal jurisdiction and venue therein.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision unless acknowledged and agreed to by us in writing.
